Mr. Atul Sharma, Managing Partner addresses at India Infrastructure Forum’s Roundtable on the topic “Dispute Resolution Mechanism” - 20 July 2018

India Infrastructure Forum, an initiative of India Infrastructure Publishing recently held a roundtable on Infrastructure sector on the topic “Dispute Resolution Mechanism” at India International Centre, New Delhi.

Industry leaders and policy makers were invited to discuss the issues and to evaluate the current practices on dispute resolution in India, their successes and failures, to discuss new government measures to streamline institutional arrangements for dispute resolution and to deliberate on the necessary steps to address implementation-related challenges.

Our Managing Partner, Mr. Atul Sharma was invited to give the baseline presentation where he discussed the success of arbitration as a dispute resolution mechanism. In particular he discussed the below aspects:

  1. Whether the arbitration regime in India has acquired a character of being a tool for effective adjudication of disputes outside the court system;
  2. The impact of proposed amendments in the “Arbitration and Conciliation (Amendment) Bill, 2018”;
  3. Various success stories from his experiences showcasing the substantial impact of the arbitration amendments of 2015, particularly in the infrastructure sector.
